Data collection on this website

Who is responsible for data collection on this website?

Data processing on this website is carried out by the website operator. You can find their contact information in the “Notice on the Responsible Entity” section of this privacy policy.

How do we collect your data?

Your data is collected in part by you providing it to us. This can happen, for example, when you enter data into a contact form.

Some of the data is collected to ensure the website is provided error-free. Other data can be used to analyse your user behaviour.

The use of IONOS is based on Art. 6 para. 1 lit. f GDPR. We have a legitimate interest in the most reliable presentation of our website. If a corresponding consent has been requested, processing will only be based on Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG, if the consent includes the storage of cookies or access to information on the user’s terminal device (e.g., device fingerprinting) in the sense of the TTDSG. The consent can be revoked at any time.

3. General information and mandatory information

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the legal data protection regulations and this privacy policy.

If you use this website, various personal data will be collected.
Personal data is data that can be used to identify you personally. This privacy policy explains which data we collect and why we use it. It also explains how and for what purpose this is done.
We would like to point out that data transmission over the Internet (e.g., communication by email) can have security vulnerabilities. Complete protection of data against access by third parties is not possible.

Note on the responsible party

The party responsible for the processing of data on this website is:

KaiserFranz-Engineering UG (haftungsbeschränkt)
Henricistraße 44
52072 Aachen

Phone: [Phone number of the responsible party]
Email: info@kaiserfranz-engineering.com

The responsible party is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data (e.g., names, email addresses, etc.).

Duration of storage

If no specific storage period is specified in this privacy policy, your personal data will be stored with us until the purpose for the data processing is no longer applicable. If you assert a legitimate deletion request or revoke your consent to data processing, your data will be deleted, unless we have any other legally permissible reasons for storing your personal data (e.g., tax or commercial retention periods); in the latter case, the data will be deleted after the expiration of these reasons.

General information on the legal bases for data processing on this website

If you have given your consent to the processing of your personal data, we will process your personal data based on Art. 6 para. 1 lit. a DSGVO or Art. 9 para. 2 lit. a DSGVO, if special categories of data according to Art. 9 para. 1 DSGVO are processed. In the case of an express consent to the transfer of personal data to third countries, the data processing is also based on Art. 49 para. 1 lit. a DSGVO. If you have given your consent to the storage of cookies or to the access to information on your terminal device (e.g., computer, smartphone, etc.), the data processing is based on Art. 6 para. 1 lit. a
DSGVO. If processing is necessary to fulfil a contract to which you are a party, or to carry out precontractual measures at your request, the data processing is based on Art. 6 para. 1 lit. b DSGVO. If the data processing is necessary to fulfil a legal obligation to which we are subject, the data processing is based on Art. 6 para. 1 lit. c DSGVO. If the data processing is necessary to protect the legitimate interests of us or a third party and if there are no reasons to assume that you have an
overriding legitimate interest in the non-disclosure of your data, the data processing is based on Art.
6 para. 1 lit. f DSGVO.

Note on the transmission of data to the USA and other third countries

We use tools from companies based in the USA or other third countries that are not data protection compliant. If these tools are active, your personal data may be transferred to and processed in these third countries. We would like to point out that the level of data protection in these countries is not comparable to that in the EU. For example, US companies are required to disclose personal data to security authorities without you being able to take legal action against this as the affected party. It cannot be ruled out that US authorities (e.g., secret services) will process, evaluate and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.

Revocation of your consent to data processing

Many data processing activities are only possible with your express consent. You can revoke an already granted consent at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct advertising (Art. 21 DSGVO)

IF DATA PROCESSING IS BASED ON ART. 6 PARA. 1 LIT. E OR F DSGVO, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE LEGAL BASIS ON WHICH THE PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA, UNLESS WE CAN PROVE COMPELLING LEGITIMATE REASONS FOR THE PROCESSING THAT OUTWEIGHS YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES TO ENFORCE, EXERCISE OR DEFEND LEGAL CLAIMS (OBJECTION ACCORDING TO ART. 21 PARA. 1 DSGVO).

IF YOUR PERSONAL DATA IS PROCESSED TO CONDUCT DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSES OF SUCH MARKETING AT ANY TIME; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS CONNECTED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION ACCORDING TO ART. 21 PARA. 2 DSGVO).

Right of complaint to the competent supervisory authority

In the event of breaches of the GDPR, the data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or place of the alleged infringement. The right to complain shall not affect any other administrative or judicial remedies.

Right to data portability

You have the right to receive data that we process automatically based on your consent or in fulfilment of a contract in a common, machine-readable format. If you request the direct transfer of the data to another responsible party, this will only be done if it is technically feasible.

Information, deletion and correction

You have the right, under the applicable legal provisions, to request information at any time about your stored personal data, its origin and recipients, and the purpose of the data processing, and, if applicable, a right to correction or deletion of this data. You can contact us for this purpose and for further questions on the subject of personal data at any time.

Right to restrict processing

You have the right to request the restriction of the processing of your personal data. You can contact us for this purpose at any time. The right to restrict processing exists in the following cases:

  • If you contest the accuracy of your data stored with us, we generally need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of the data processing instead of its deletion.
  • If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of its deletion.
  • If you have lodged an objection pursuant to Art. 21 para. 1 GDPR, a balance must be struck between your interests and our interests. As long as it has not been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, these data may only be processed – with the exception of storage – with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of a significant public interest of the European Union or a member state.

SSL or TLS encryption

This page uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator.
You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.
If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Objection to advertising e-mails

The use of contact data published in the context of the imprint obligation for the purpose of sending unsolicited advertising and information material is hereby contradicted. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising
information, such as spam e-mails.

4. Data collection on this website

Cookies

Our websites use so-called “cookies”. Cookies are small data packages that do not damage your device. They are either temporarily stored for the duration of a session (session cookies) or permanently (permanent cookies) on your device. Session cookies are automatically deleted after your visit. Permanent cookies are stored on your device until you delete them yourself or they are automatically deleted by your web browser.

Cookies can come from us (first-party cookies) or from third parties (so-called third-party cookies). Third-party cookies enable the integration of certain services from third parties within websites (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary as certain website functions would not work without them (e.g., the shopping basket function or the display of videos). Other cookies can be used to evaluate user behaviour or for advertising purposes.

Cookies that are necessary for the conduct of the electronic communication process, for the provision of certain requested functions (e.g., for the shopping basket function) or for the optimization of the website (e.g., cookies for measuring web audience) (necessary cookies) are stored based on Art. 6 para. 1 lit. f GDPR, unless another legal basis is specified.

The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent has been requested for the storage of cookies and similar recognition technologies, the processing is solely based on this consent (Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TMG); the consent can be revoked at any time.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when you close the browser. If you deactivate cookies, the functionality of this website may be restricted.
For information on which cookies and services are used on this website, please refer to this privacy policy.

Contact form

If you send us requests via the contact form, your details from the request form, including the contact details you provided there, will be stored in order to process the request and in case of follow-up questions. We will not share this information without your consent.
The processing of the data entered into the contact form takes place exclusively on the basis of your consent (Art. 6 para. 1 lit. a GDPR). You can revoke this consent at any time. An informal message by e-mail to us is sufficient. The legality of the data processing operations carried out up to the
revocation remains unaffected by the revocation.

The data entered by you in the contact form will remain with us until you request us to delete it, revoke your consent to storage or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions – in particular retention periods – remain unaffected.

Request by email, phone, or fax

If you contact us by email, phone, or fax, your request including any personal data (name, request) will be stored and processed by us for the purpose of handling your matter. We will not disclose this data without your consent.

The processing of this data is based on Art. 6 para. 1 lit. b GDPR if your request is related to the fulfilment of a contract or is necessary for the performance of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the requests addressed to us (Art. 6 para. 1 lit. f GDPR) or on your consent (Art. 6 para. 1 lit. a GDPR) if this has been requested; the consent can be revoked at any time.

The data you send to us via contact requests will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your matter has been completed). Legal requirements, in particular statutory retention periods, remain unaffected.
